Consent to be Contacted

Sparrow Consent to be Contacted by Telephone, Email, or Postal Mail 

 

Effective Date: 11/20/2024 

 

In this authorization, “we,” “us,” and “our” refer to: (1) Evolve Bank & Trust, the issuer of Sparrow credit card, (2) Sparrow Financial, Inc., the servicer of the Sparrow credit card, and (3) their service providers. 

 

By submitting information to us, you agree that we (including any companies working on our behalf) have your explicit permission and consent authorizing us to contact you at that number, subject to your privacy preferences. You agree that we (including any companies working on our behalf) may contact you, including calls, text message(s), or email, at any phone number, email address, text number or mailing address you provide to us, from which you contacted us, or we receive and believe we can reach you at, to the extent permitted by applicable law, for any lawful purpose, including for purposes of collections. Your consent allows us to use text messaging, artificial or prerecorded voice messages and automatic dialing technology, or any system capable of storing and dialing telephone numbers to contact you about informational, servicing, collections, or other activities relating to your account, but not for telemarketing or sales calls. Automated messages may be played when the telephone is answered, whether by you or someone else. Where allowed by law, we also may contact other individuals who may be able to provide updated employment, location, and/or contact information for you.  

 

The express consent in this provision includes and extends to any affiliates, agents, contractors, representatives, servicers, service providers, or assignees. 

 

By providing us a mobile phone number for your Sparrow credit card account or Sparrow application, you are certifying that you are the account holder for the mobile phone account or you have permission from the mobile phone account owner to use this number for your Sparrow account or application. You may have the option to enroll in specific subscription text alerts regarding your Sparrow account, however, you may also receive text messages related to fraud activity independent of your other preferred subscription enrollments. 

 

To stop reoccurring text messages, you can also simply reply “STOP” to any text message Sparrow sends you. To stop emails, you can follow the opt-out instructions included at the bottom of the emails Sparrow sends you; if an email does not include these instructions, it is a transactional or relationship message and you cannot opt out of receiving it in the future. For help with any text messaging program reply HELP to the text message that you receive. Frequency of text messages varies. Message and data rates may apply to calls and texts. 

 

We have the right to change the content of any text message or email and its delivery frequency including discontinuation of the text messages or emails in their entirety at any time without prior notice to you, subject to applicable law. If your mobile phone is off, out of range, or subject to a variety of other conditions, you may not receive the messages or messages may be delayed. We do not guarantee continuous, uninterrupted or secure message services. We cannot guarantee that text messages provided through your wireless carrier will be delivered to you. Neither Sparrow nor your wireless carrier is liable to you for any delayed or undelivered text messages. You must notify us in the event that your phone number is changed or deactivated.

 

You acknowledge that our text messages and emails are sent to you without being encrypted and may include information about an application or your Sparrow credit card account. The information in the text messages and emails are provided on an “AS IS,” and “AS AVAILABLE” basis. We will not be responsible for any loss or damage that could result from interception or misuse of any information by third parties or undelivered text messages or emails.
